Financial Issues

Here at Butcher and Barlow we are able to advise on all financial issues arising from the breakdown of a marriage, the breakdown of a civil partnership, or the breakdown of a relationship where you have not been married.  Our Family Law team has the expertise to deal with all ranges of financial matters. We have experience in dealing with instructions where there are few assets, to high net worth cases where there are substantial assets.

We will initially advise you on the process for dealing with financial matters and see whether it is possible to reach an agreement without issuing court proceedings.  We will also advise you on the option of attending mediation to assist you in reaching an agreement.

In some cases, court proceedings are necessary and we are able to advise and assist you throughout the court process.  We recognise that court proceedings can be stressful and we aim to conduct any court proceedings in the least stressful and most cost effective way possible.

The issues that may be considered in relation to financial matters include:

  • obtaining disclosure of a parties’ financial position;
  • the sharing of pensions;
  • the division of savings and other capital;
  • the sale or transfer of ownership of properties; and
  • claims for maintenance and lump sum payments.
